Brin Benjamin Brody

Managing Director | High Court Litigation | Acting Judge of the High Court

Brin Brody is the Managing Director of Wheeldon Rushmere & Cole Inc. in Makhanda (Grahamstown), where he practises principally in High Court and complex litigation. He holds BA and LLB degrees and has extensive experience in commercial, administrative and constitutional law, family law, labour law and substantial civil disputes.

Brin has on several occasions been appointed as an Acting Judge of the High Court of South Africa, Eastern Cape Division. He has presided over civil and criminal matters, delivered numerous reported judgments and sat as a member of a Full Court hearing appeals. His judgments are publicly available on SAFLII.

A significant part of his practice has involved public-interest and administrative litigation. Over many years he has acted in proceedings concerning municipal governance, service delivery, education and the constitutional and statutory obligations of organs of state. He has been particularly involved in litigation concerning Makana Municipality and Makhanda, with a number of these matters attracting regional and national media attention.

Brin has also played a leading role in efforts to retain and strengthen the main seat of the Eastern Cape Division of the High Court in Makhanda through his involvement with the Makhanda High Court Action Committee.

Beyond legal practice, he has a long record of involvement in civic and educational organisations in Makhanda. He has chaired numerous community and institutional bodies, including the Graeme College Board and St Andrew’s Preparatory School Board, and has served on the Council of St Andrew’s College and as a trustee.

His experience as both a practising High Court litigator and an Acting Judge provides him with an extensive understanding of litigation and the administration of justice from both sides of the Bench.
